Lake Barcroft Security Guidelines

These guidelines govern actions of security officers employed by LBA and distinguish between ORDERLY and DISORDERLY conduct and between LAKE BARCROFT RESIDENTS AND GUESTS and NON-BARCROFT RESIDENTS and provide as follows:

11 ORDERLY CONDUCT - LAKE BARCROFT RESIDENTS AND GUESTS

The Security officer is authorized to approach and seek identification from any person on the Lake, the beaches or other common area while on patrol. Once the officer has established that a Lake resident is present and that the resident and his or her guest(s) (under LBA rules an adult resident may have up to 4 guests at one time) are not disorderly, loud or otherwise causing a disturbance to others, the officer shall inform the resident and his or her guest(s) that they must remain orderly and that for their own security they should give thought to leaving within a reasonable time. However, no further action should be taken.

12 ORDERLY CONDUCT - NON-LAKE BARCROFT RESIDENTS

Non-Lake Barcroft residents are never permitted on the Lake, beaches, or common areas, without a responsible Lake Barcroft resident being present. Accordingly, such persons are trespassers and should be asked to leave the premises immediately. If the individual or individuals refuse, the officer should seek the assistance of other law enforcement officers to forcibly remove the individuals from the Lake Barcroft area.

13 DISORDERLY CONDUCT - LAKE BARCROFT RESIDENTS AND GUESTS

No Lake Barcroft resident has the right to cause any disturbance on the Lake, the beaches or in the common areas. Accordingly, the Security officer is authorized to take such action as is necessary to stop the disturbance and to remove such individuals (both Lake and non-Lake residents) from the Lake, beach or common area. If the parties refuse to leave, the officer is authorized to seek such additional law enforcement help as is necessary to remove such persons. If any ordinance or local law is violated, the officer may take such other action as he or she deems appropriate, including ticketing or arresting such individuals if necessary. The officer shall report the incident to the LBA Board and the Lake Barcroft resident will be liable for any damage or destruction of common property, including the costs of litigation and reasonable attorneys' fees.

The LBA Board also retains the right to revoke the Lake resident's beach and boating privileges in the event of any subsequent violation of these Guidelines or any revised Security Guidelines.

14 DISORDERLY CONDUCT - NON-LAKE BARCROFT RESIDENTS

The guidelines that apply to Lake residents causing a disturbance shall also apply to Non-Lake residents found to be causing a disturbance. In addition, the officer shall provide the names and addresses of any individuals found to be causing a disturbance to the LBA Board so that the Board may take any legal action as is necessary to stop any future trespassing and for damages to property, if appropriate.
